Terms of Use

This app is licensed to you under Apple's Standard End User License Agreement (EULA). By downloading or using 1% Better, you agree to the terms of that EULA in addition to the terms below.

1. Acceptance of Terms

By downloading, installing, or using the 1% Better app ("App"), you agree to be bound by these Terms of Use ("Terms") and Apple's Standard EULA. If you do not agree to both, do not download or use the App.

These Terms constitute the entire agreement between you and Jugal Mistry ("Developer," "we," "us") regarding your use of the App. Apple is not a party to these Terms.

2. License to Use

Subject to your compliance with these Terms and Apple's EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device you own or control, solely for personal, non-commercial purposes.

3. Subscriptions and In-App Purchases

1% Better offers the following optional in-app purchases, processed entirely by Apple:

Free trial: A 7-day free trial is available for subscription plans. The trial begins when you first tap "+ Add Category" — not on install. No payment is required until the trial ends. Cancel any time before the trial ends to avoid charges.

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.

Cancellation: Manage or cancel subscriptions at any time in Settings → Apple ID → Subscriptions on your iPhone or iPad. Deleting the App does not cancel your subscription.

All billing, receipts, and refund requests are handled exclusively by Apple. We do not collect or store any payment information.

4. Free Tier

The free tier includes one global habit tracker with the full feature set: compounding graph (all 4 layers), calendar history, streak tracking, past entry editing, push notifications, iCloud sync, and home screen widget. No credit card or account is required for the free tier.

Premium unlocks up to 10 total habit trackers with custom categories, icons, colors, and per-tracker decay rules. We reserve the right to adjust free tier features with reasonable notice.

5. Your Data

All habit data is stored locally on your device and synced to your private Apple iCloud account via CloudKit. We have no access to your data. See our Privacy Policy for full details.

6. Intellectual Property

The App, including its name "1% Better," logo, UI design, copy, and underlying code, is owned by Jugal Mistry and protected under applicable copyright, trademark, and intellectual property laws. These Terms do not transfer any ownership rights to you.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use is at your sole risk.

1% Better is a personal productivity tool. It does not provide medical, psychological, financial, or any other professional advice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Jugal Mistry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of (or inability to use) the App.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid for the App in the 12 months preceding the claim or (b) $10 USD.

9. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of competent courts in India. To the extent Apple's EULA provides additional dispute resolution terms, those terms apply to App Store purchase-related claims.

10. Termination

We may suspend or terminate your license to use the App if you violate these Terms. Upon termination, you must cease all use of the App. You may terminate your use at any time by deleting the App from your device. Termination does not entitle you to a refund — contact Apple for refund requests.

11. Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top reflects the most recent revision. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via an in-app notice.

12. Contact

Apple App Store — Required Disclosures

The following disclosures are required by Apple for all apps distributed on the App Store:

EULA: This App is subject to Apple's Standard End User License Agreement.

Parties: These Terms of Use are a legal agreement between you and Jugal Mistry. Apple Inc. is not a party to this agreement and is not responsible for the App or its content.

Scope of License: The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the App Store Usage Rules.

Maintenance & Support: Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Any questions, complaints, or claims regarding the App should be directed to [email protected], not Apple.

Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Product Claims: Jugal Mistry, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Jugal Mistry (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

U.S. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
